Appeal from an order denying a motion of the town of St. Martin for judgment in its favor notwithstanding the verdict of the
jury or, in the alternative, for a new trial. Petitioners, Arcella Lieser and Thecla Spanier, filed their petition on July 25, 1957, with the town boards of the towns
of St. Martin and Zion in Stearns County for the establishment of a town road on the line between said towns. The petition
was not approved by a majority of the members of the two town boards, and the petitioners appealed to the district court from
the determination. The matter was tried before the district court and a jury, the jury being asked to answer the following
interrogatory:
